We all know that the Constitution guarantees the right to Habeas Corpus. Would you want to debate Senator Arlen Specter (R-PA) that this right is somehow negotiable? I didn’t think so, but somehow we have an Attorney General in place, Alberto Gonzalez, who did just that. Yesterday Gonzalez argued, “There is no express grant of habeas in the Constitution.†To which Sen. Specter replied, “Wait a minute. The constitution says you can’t take it away, except in the case of rebellion or invasion. Doesn’t that mean you have the right of habeas corpus, unless there is an invasion or rebellion? You may be treading on your interdiction and violating common sense, Mr. Attorney General.†Here is video
